1. Agreement to Terms

By accessing or using HiyaMojo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use the Service.

HiyaMojo is operated by an individual sole trader based in Vilnius, Lithuania (European Union). These Terms are governed by Lithuanian law and applicable European Union regulations. Our contact details are in Section 17.

These Terms work together with our Privacy Policy, which explains how we handle your personal data.

2. Eligibility and Account Requirements

Age requirements

You must be at least 13 years old to use the Service. By using HiyaMojo, you represent that you meet this requirement. In the EU, EEA, and UK, the minimum age for consenting to online services is between 13 and 16 depending on your country; if you are below that age, you may use the Service only with the consent of a parent or guardian.

Account registration

To use HiyaMojo, you create an account by providing:

a valid email address;
a unique username (3-20 characters);
a secure password (minimum 8 characters) for local accounts.

You may also register using Google or Facebook sign-in, in which case we create a username based on your profile. You agree to provide accurate information and to keep it up to date.

Account security

You are responsible for:

maintaining the confidentiality of your account credentials;
all activity that occurs under your account;
notifying us promptly of any unauthorised access.

Local accounts require email verification before some features are available. We will never ask for your password by email or other communication.

3. Description of Service

HiyaMojo is a gamified productivity and habit-tracking application that lets you:

create habit and to-do tasks and organise them with tags;
rate the effort of each task, log completions, and set daily limits;
earn points, medals, streaks, and "Mojo", with optional bonus days and increasing rewards;
track your progress with charts, targets, and insights;
take "rest" periods and receive optional email reminders and summaries.

The Service is a web application that works in any modern browser - no download is required. Points and rewards are part of a motivational game layer and have no monetary value.

4. Acceptable Use Policy

Permitted uses

You may use HiyaMojo for personal productivity tracking and self-improvement. This includes creating tasks, logging completions, and monitoring your progress.

Prohibited uses

You agree NOT to:

use the Service for any illegal or unauthorised purpose;
violate any laws in your jurisdiction;
attempt to gain unauthorised access to our systems;
interfere with or disrupt the Service or its servers;
transmit viruses, malware, or harmful code;
use bots or automated systems to access the Service;
harvest or collect data about other users;
impersonate another person or entity;
use the Service to harass, abuse, or harm others;
reverse engineer or attempt to extract source code.

5. Content and Intellectual Property

Your content

You retain ownership of the content you create, including task names and notes, tags, logs, and your feedback and communications.

You grant HiyaMojo a worldwide, non-exclusive, royalty-free licence to host, store, back up, process, and display your content for the sole purpose of operating and securing the Service for you, and to create aggregated or anonymised statistics that do not identify you. This licence ends when you delete the relevant content or your account, except for content we must retain as described in the Privacy Policy.

HiyaMojo's intellectual property

The Service, including its original content, features, and functionality, is owned by HiyaMojo and protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

6. Service Availability and Changes

We aim to provide continuous access to HiyaMojo but cannot guarantee uninterrupted service. We may:

modify or discontinue any part of the Service;
impose limits on features or restrict access;
perform maintenance that temporarily affects availability;
update features or functionality.

HiyaMojo is currently provided free of charge. We may introduce paid features in the future; if we do, they will be subject to separate purchase terms presented at the time, and core functionality will remain available. We will give reasonable notice of significant changes that adversely affect you.

7. Service Limitations

To keep the Service running well for everyone, we apply reasonable limits, including:

username length: 3-20 characters;
password length: at least 8 characters;
limits on the length of contact and feedback messages;
rate limits on actions such as logins, registrations, and email-triggering requests to protect against abuse.

These limits may change as the Service evolves.

8. Data Export and Portability

You can request a copy of your data at any time by contacting support@hiyamojo.com from your registered email address, and we will provide it in a commonly used, portable format. We may add a self-service export feature in the future. Your privacy rights are described in full in our Privacy Policy.

9. Termination

Your right to terminate

You may close your account at any time by:

using the "Delete Account" feature in your profile settings; or
contacting our support team.

When you delete your account, your personal content is deleted and your account is deactivated and de-identified. Certain limited records are retained for security and legal compliance, exactly as described in the Privacy Policy. Account deletion cannot be undone.

Our right to terminate

We may suspend or terminate your account, with notice where reasonably possible, if you:

breach these Terms;
engage in prohibited uses;
provide false or misleading information; or
engage in conduct that is harmful to other users or the Service.

10. Disclaimers

To the extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and the accuracy or reliability of content.

HiyaMojo is a productivity tool and is not a substitute for professional advice on health, fitness, mental wellness, or any other specialised domain.

Nothing in these Terms excludes or limits rights or remedies that cannot be excluded or limited under applicable law, including mandatory consumer protections under Lithuanian and EU law.

11. Limitation of Liability

To the maximum extent permitted by law, HiyaMojo and its operator will not be liable for:

any indirect, incidental, special, or consequential damages;
loss of profits, data, use, or goodwill;
service interruptions or data loss.

These limitations do not apply to liability that cannot be excluded or limited under applicable law - for example, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for breaches of your mandatory statutory consumer rights. Because the Service is currently free, our total liability that can lawfully be limited will not exceed the amount you have paid us (currently €0).

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless HiyaMojo and its operator from claims, damages, losses, and reasonable expenses that arise from your unlawful use of the Service, your breach of these Terms, or your violation of the rights of a third party. This does not apply to the extent the loss is caused by us, and nothing here limits your mandatory rights as a consumer.

13. Third-Party Services

HiyaMojo integrates with third-party services, including:

Google and Facebook for optional sign-in;
Google Analytics, PostHog, and the Reddit Pixel for analytics and measurement;
Google reCAPTCHA for abuse prevention;
SendGrid for email delivery;
Google Cloud Platform for hosting.

Your use of these services is also subject to their own terms and privacy policies. How we use them, and your choices, are described in our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by the laws of Lithuania and applicable European Union regulations, without regard to conflict-of-law rules.

We would like to resolve any dispute informally first, so please contact us before taking formal action. If a dispute cannot be resolved, it may be brought before the competent courts of Lithuania.

If you are a consumer in the EU, EEA, or UK, you keep the benefit of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in your home country and use the consumer dispute-resolution bodies available there.

15. Changes to These Terms

We may update these Terms from time to time. When we make changes:

we will update the "Last updated" date on this page;
for material changes, we will notify you by email or in-app notification;
your continued use of the Service after the changes take effect means acceptance.

16. Miscellaneous

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HiyaMojo regarding the Service.

No waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.
